General

These terms and conditions (the “Agreement”) set forth the general terms and conditions of your use of ArachnoHealth (“we”), and its associated website www.arachnohealth.com and its mobile application ArachnoHealth (collectively referred to as Site).

In addition, this policy explains to the Beneficiary/provider (“user”, “you”, “Customers”, “Clients”, “ArachnoHealth Community”, or “Your”) their rights and responsibilities. The User Guide Content clauses are incorporated throughout the document.

This policy does not apply to practices of organizations that we do not own or control, or to individuals that we do not employ or manage.

This Agreement is legally binding between Users and ArachnoHealth web/app platform, produced and managed by ArachnoTechFZ (A Company incorporated and registered in the UAE with trade license number 45000855, and registered office address BIZ00006, Compass Building, AL Shohada Road, Al Hamra Industrial Zone, Ras AL Khaimah, United Arab Emirates).

By accessing and using the Site/App, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement.

Definitions

ArachnoHealth community/customer/users: for the purpose of this document, Beneficiaries and providers are interchangeably referred to as ARACHNOHEALTH community or customers/users.

Site: reference to the ArachnoHealth website, which can be accessed through www.ArachnoHealth.com or via the ArachnoHealth mobile app.

Non-Personal Information: Refers to the set of data collected through registration or artificial intelligence, which are not personal identifiers for an individual.

Objectionable content: Posts, images, or videos uploaded in the application that contains sensitive or offensive material that can be vulgar or not tolerated by the audience.

Objectionable behavior: Behavior that is offensive. Use of inappropriate replies, judgmental, labeling, or disrespectful.

Personal Information: Refers to personal details set of data collected from the ARACHNOHEALTH community during the registration to the application or data collected by technology through cookies and other growth hack data collection. This type of information can be used for personal identification.

Beneficiary: the individual who registers in the application as a member of the community who seeks advice from a healthcare provider or is looking for healthcare services around them.

Provider: Licensed organization, or certified professional that is in the medical/healthcare field. In addition to any student/attendant/resident of a medical/health school/college/ university.

Partner: Licensed organization, or certified professional that is in the medical/healthcare field. That had a website built by ArachnoTech and linked with the Arachnohealth web/app platform through the so-called APIs.

Provided Services: refers to the company’s services accessed on the Site where the beneficiaries connect with the providers.

User Generated Content (UGC) moderation: Process put in place by ARACHNOHEALTH to monitor, flag, and attend to any breach performed. Along with actions undertaken for first-time offenders, recurrent offenders, and any objectionable content or behavior occurrence.

Contract

This Agreement is applicable to all Beneficiaries and Providers using the Site. By accepting these terms and conditions, you are accepting to respect the terms and all other users on our Site. Deviation from the terms is subject to reporting, blocking, and deletion of offenders’ accounts.

ArachnoHealth is committed to maintaining robust privacy and confidentiality for its community, to protect and preserve them from any type of offense, invasion, fraud, or abuse. Details about Privacy, confidentiality, data gathering and storing, and sharing of information can be referred to in the Privacy Policy and Cookie Policy.

This site does not provide Medical Advise

The contents of this Site, such as text, graphics, images, and other materials created by ARACHNOHEALTH or obtained from our business partners, and other materials contained on the Site (collectively, "Content") are for informational purposes only.

ARACHNOHEALTH does not engage in the practice, medicine, or provision of medical advice. ARACHNOHEALTH does not provide medical diagnoses or recommendations about the course of treatment for your particular circumstances and does not recommend or endorse any specific services, procedures, tests, products, or procedures referred to or opinions or information that may be contained in the Content for your particular circumstances.

Our Content is not intended to be a substitute for professional medical advice, diagnosis, or treatment. You should always seek the advice of your physician or another qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read on our platform. Reliance on any information provided by ARACHNOHEALTH, our employees, others appearing on the Site at the invitation of ARACHNOHEALTH, or other visitors to the Site is solely at your own risk.

IF YOU THINK YOU MAY HAVE A MEDICAL EMERGENCY, CALL YOUR DOCTOR OR EMERGENCY MEDICAL SERVICES IMMEDIATELY.

Changes and Amendments

We reserve the right to modify this Agreement and its terms related to the Site and Services from time to time in our discretion and based on our growth and improvements. We will notify you of significant changes by sending a notice to the primary email address specified in your account or by placing a prominent notice on our site. Significant changes will go into effect immediately following such notification. Non-material changes or clarifications will take effect immediately. We agree that changes can never be retroactive. We encourage you to periodically check the Site and the terms page for updates. You have the right to object, please contact us on the indicated email for more details on how.

Your continued use of the Site after the effective date of the revised Agreement will constitute your consent to those changes. However, we will not, without your consent, use your personal information in any manner different than what was stated at the time your Personal information was collected.

Minimum Age Requirements

The Site, the content, and the showcased services are not directed to anyone under the age of 16. The Site does not knowingly collect or solicit information from anyone under the age of 16, or allow anyone under the age of 16 to sign up. In the event that we learn that we have gathered personal information from anyone under the age of 16 without the consent of a parent or guardian, we will delete that information as soon as possible. Account Management

If you create an account on the Site, you are responsible for maintaining the security of your account and you are fully responsible for all activities that occur under the account and any other actions taken in connection with it. You must immediately notify us of any unauthorized uses of your account or any other breaches of security. We may, but have no obligation to, monitor and review new accounts before you sign in and start using the Site.

By filling in the information in your profile, you are agreeing to provide accurate and valid. Since the platform is about medical conditions, we understand the need to ask anonymously. You have the option to choose to ask anonymously by choosing this option while you ask.

When creating the account, and all through the use of the Site:

Read, understand, and sign the terms and conditions along with the privacy policy
Generate a strong password that contains at least a capital, a small cap letter, a symbol, and a number.
Do not share your password with anyone
Do not transfer any part of your account to anyone
Follow the law and the list of Dos and don’ts
Follow the details of the User’s Guide Content
Respect your peers and all the ARACHNOHEALTH community members by respecting the type of content you share and the responses you provide.
You are free to delete your account at any time by accessing the delete account option in the settings.
Objectionable content and behavior are not tolerated in ARACHNOHEALTH, for that matter, UGC moderation processes are put in place to oversee the content and implement the needful actions.
If you have any doubt about fraudulent customers, please report through the report button
If you have any concerns related to information posted about you that you didn’t share, please report to us immediately on the provided contact us details.

Notifications

By signing this Agreement, you approve receiving notifications from the Site in regards to your posted questions, shared posts, changes in policies in the Site, communications with Healthcare providers, marketing and advertisements, along with any notifications about promotions, articles, and many more.

If you wish to stop receiving notifications about marketing and advertisements, please indicate so at the end of this document.

Rights of the User

You own the content you post on the Site, feedback, and personal information while giving us the right to use this information for statistics and quality assurance. Refer to the Privacy Policy for more information.

You and ARACHNOHEALTH agree that if the content includes personal data, it is subject to our Privacy Policy.

You and ARACHNOHEALTH agree that we may access, store, process, and use any information and personal data that you provide in accordance with, the terms of the Privacy Policy and your choices (including settings).

By submitting suggestions or other feedback regarding our services to ARACHNOHEALTH, you agree that we can use and share such feedback for any purpose without mentioning your personal information.

You promise to only provide information and content that you have the right to share, and that your profile will be truthful.

You agree to only provide content or information that does not violate the law or anyone’s rights (including intellectual property rights). You also agree that your profile information will be truthful. ARACHNOHEALTH may be required by law to remove certain information or content in certain countries.

You have the right to report and/or block any content you may encounter content or information that might be inaccurate, incomplete, delayed, misleading, illegal, offensive, or otherwise harmful. ArachnoHealth generally reviews content provided by our members or others, and necessary measures are followed, however, please notify us of any concerns.

UGC Moderation and User Guide

We reserve the right to limit your use of the Site, including the number of your connections and your ability to contact other Members. ARACHNOHEALTH reserves the right to restrict, suspend, or terminate your account if you breach this Contract or the law or are misusing the Site (e.g., violating any of the Dos and Don’ts or Professional Community Policies).

Our team has in place a process for content monitoring, actions will be undertaken with offenders. Depending on the offense and the number of occurrences, the admin team will remove the objectionable posts and send a warning notice to the offender. In extreme circumstances, we reserve the right to immediately terminate your access to the Site.

If we determine that you have violated any provision of this Agreement or that your conduct or content would tend to damage our reputation and goodwill, we may suspend, disable, or delete your account (or any part thereof). If we delete your account for the foregoing reasons, you may not re-register for our Site (unless we formally invite you to do so) and, without limitation, you may forfeit any pending, current, or future promotional offers, credits, or any unredeemed vouchers in your account.

If you commit fraud or falsify information in connection with your use of the Site, or in connection with your account on the Site, your account will be terminated immediately and we will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions and we reserve the right to hold you liable for any and all damages caused by your conduct, to pursue legal action through relevant local and national authorities and to notify your internet service provider of any fraudulent activity we associate with you or your use of the Site. Finally, we may block your email address and Internet protocol address to prevent attempts at further registration.

Communicating, transmitting, or posting:

Material that is in violation of applicable laws, regulations, and/or any international, federal, provincial, or state regulations, rules, laws, or local ordinances;
Material that is obscene or immoral in purpose and content; and/or
to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability.

Intellectual Property and Copyright

"Intellectual Property Rights" means all present and future rights conferred by statute, common law or equity in or in relation to any copyright and related rights, trademarks, designs, patents, inventions, goodwill, and the right to sue for passing off, rights to inventions, rights to use, and all other intellectual property rights, in each case whether registered or unregistered and including all applications and rights to apply for and be granted, rights to claim priority from, such rights and all similar or equivalent rights or forms of protection and any other results of intellectual activity which subsist or will subsist now or in the future in any part of the world.

ARACHNOHEALTH reserves all of its intellectual property rights in the services provided by the Site. Trademarks and logos used in connection with the services are the trademarks of their respective owners. ARACHNOHEALTH, and “in” logos and other trademarks, service marks, graphics, and logos used for our Provided Services are trademarks or registered trademarks of ARACHNOHEALTH.

ARACHNOHEALTH respects the identity of the organizations in the platform. Brands and advertisements posted by third parties are copyrighted and are not to be missed.

This Site may contain material protected by third-party intellectual property rights. All or any other trademarks not owned by us, our affiliates, our partners, or our licensors that appear on the Site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by us. All content appearing on the Site either is the exclusive property of ARACHNOHEALTH or is being used with permission of the owning affiliate, partners, or licensor. Any copying, distributing, transmitting, posting, linking, deep linking, or otherwise modifying of the Site without the express written permission of ARACHNOHEALTH is prohibited. Any violation of this requirement may result in a copyright, trademark, or other Intellectual Property Rights infringement that may subject you to civil and/or criminal penalties.

This Agreement does not transfer to you any intellectual property owned by ARACHNOHEALTH or third parties, and all rights, titles, and interests in and to such property will remain (as between the parties) solely with ARACHNOHEALTH. You acknowledge that you do not acquire any rights or title to any intellectual property material from the Site.

All trademarks, service marks, graphics, and logos used in connection with the Site and Provided Services, are trademarks or registered trademarks of ARACHNOHEALTH or its licensors. Other trademarks, service marks, graphics, and logos used in connection with the Site and Provided Services may be the trademarks of other third parties. Your use of the Site and Services grants you no right or license to reproduce or otherwise use any of ARACHNOHEALTH or third-party trademarks.

You may not modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part. You will not upload, post or otherwise make available on the Site any material protected by copyright, trademark, or another proprietary right without the express permission of the owner of the copyright, trademark, or another proprietary right. ARACHNOHEALTH has no express burden or responsibility to provide you with indications, markings, or anything else that may aid you in determining whether the material in question is copyrighted or trademarked. You will be solely liable for any damage resulting from any infringement of copyrights, trademarks, proprietary rights, or any other harm resulting from such a submission. By submitting material to any public area of the Site, you warrant that the owner of such material has expressly granted a royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, and distribute such material (in whole or in part) worldwide and/or to incorporate it in other works in any form, media or technology now known or hereafter developed for the full term of any copyright that may exist in such material. You also permit any other end user to access, view, and store or reproduce the material for that end user's personal use.

ArachnoHealth Dos and Don’ts

ArachnoHealth is a community of professionals. This list of “Dos and Don’ts” along with our Policies limits what you can and cannot do on our Site.

Dos

You agree that you will:

Comply with all applicable laws, including, without limitation, privacy laws, intellectual property laws, anti-spam laws, export control laws, tax laws, and regulatory requirements.
Provide accurate information to us and keep it updated.
Use your real name on your profile.
Use the Provided Services in a professional manner.
Access all services that help you in clarifying your concern.
Access the most up-to-date and valid responses from providers.
Have the opportunity to extend the service and meet the selected provider in appointments.
Benefit from the platform in all its aspects.
Share your concerns about any member of the community who does not respect the limits and is disrespectful, abusive, shares objectionable content, or has objectionable behavior.
Share information about others when you are legally allowed to.

Don’ts

Create a false identity on ArachnoHealth, misrepresent your identity, create a member profile for anyone other than yourself (a real person), or use or attempt to use another’s account;
Develop, support, or use software, devices, scripts, robots, or any other means or processes (including crawlers, browser plugins, and add-ons, or any other technology) to scrape the Services or otherwise copy profiles and other data from the Provided Services;
Override any security feature or bypass or circumvent any access controls or use limits of the Provided Services (such as caps on keyword searches or profile views);
Copy, use, disclose, or distribute any information obtained from the Provided Services, whether directly or through third parties (such as search engines), without the consent of ArachnoHealth;
Disclose information that you do not have consent to disclose (such as confidential information of others (including your employer);
Violate the intellectual property rights of others, including copyrights, patents, trademarks, trade secrets, or other proprietary rights. For example, do not copy or distribute (except through the available sharing functionality) the posts or other content of others without their permission, which they may give by posting under a Creative Commons license;
Violate the intellectual property or other rights of ArachnoHealth, including, without limitation, (i) copying or distributing our learning videos or other materials or (ii) copying or distributing our technology, unless it is released under open-source licenses; (iii) using the word “ArachnoHealth” or our logos in any business name, email, or URL
Post anything that contains software viruses, worms, or any other harmful code;
Reverse engineer, decompile, disassemble, decipher, or otherwise attempt to derive the source code for the Provided Services or any related technology that is not open source;
Imply or state that you are affiliated with or endorsed by ArachnoHealth without our express consent (e.g., representing yourself as an accredited ArachnoHealth trainer);
Rent, lease, loan, trade, sell/re-sell, or otherwise monetize the Provided Services or related data or access to the same, without ArachnoHealth’s consent;
Deep-link to our Provided Services for any purpose other than to promote your profile or a Group on our Services, without ArachnoHealth’s consent;
Use bots or other automated methods to access the Provided Services, add or download contacts, send or redirect messages;
Monitor the Provided Services’ availability, performance, or functionality for any competitive purpose;
Engage in “framing,” “mirroring,” or otherwise simulating the appearance or function of the Provided Services;
Overlay or otherwise modify the Provided Services or their appearance (such as by inserting elements into the Provided Services or removing, covering, or obscuring an advertisement included in the Provided Services);
Interfere with the operation of, or place an unreasonable load on, the Provided Services (e.g., spam, denial of service attack, viruses, gaming algorithms); and/or
Violate the Professional Community Policies or any additional terms concerning specific Provided Services that are provided when you sign up for or start using such Provided Services.

Acceptance of this Policy

You acknowledge that you have read and understood this Policy and agree to all its terms and conditions. If you do not agree to abide by the terms of this Policy, you are not authorized to access or use the Site and provide services.
